In today’s housing landscape, HUD continues to allocate significant funds to local housing authorities for conducting testing through shoppers/testers. These testers are legally permitted to use deceptive tactics to determine whether employees or policies are discriminatory. Although it may seem like entrapment, the ultimate goal is to ensure equal treatment across all protected classes.

Earlier this year, HUD introduced inflation-adjusted civil penalty amounts for violations of various housing-related laws, including the federal Fair Housing Act.

Under these revised penalties:

  • A first-time violation of the Fair Housing Act can result in a maximum fine of $23,011.
  • For individuals or companies with a prior violation within the last five years, the maximum penalty increases to $57,527.
  • Repeat violators with two or more offenses within the last seven years can face fines up to $115,054 for each additional violation.
